Moncton Lawyer Advocates for Legal Right to Clean Water in New Brunswick

Exploring clean water law and water quality protection

Richelle Martin, an environmental lawyer from East Coast Environmental Law, recently urged New Brunswick legislators to enshrine the right to clean water into provincial law.

 

Addressing a legislative committee in Fredericton, Martin emphasized that the absence of such legislation can lead to unequal access to this essential resource.

 

She stated, "This protection of the right to clean water will recognize the importance of water for human health and well-being."

 

Martin highlighted that while the Canadian Environmental Protection Act acknowledges a general right to a healthy environment, no Canadian province specifically guarantees the right to clean water.

 

She noted that Ontario, Quebec, and the territories have frameworks protecting environmental rights but lack explicit provisions for clean water.

 

Martin also called for formal mechanisms to enhance cooperation between the government and Indigenous communities on freshwater issues.

 

In contrast, representatives from J.D. Irving, Limited cautioned against regulatory changes that might negatively impact the economy.

 

They argued that the existing Clean Water Act provides a solid foundation and warned that additional regulations could hinder the forestry sector's competitiveness.

 

With the forestry industry contributing approximately eight percent to New Brunswick's GDP, they stressed the importance of balancing environmental protection with economic growth.

 

The legislative committee continues to hear from various stakeholders as it considers updates to the Clean Water Act.

 

Discussions are ongoing to find a path that ensures both the protection of water quality and the economic vitality of the province.
